The In re Washington Mutual Mortgage Backed Securities Litigation Settlement resolves class action litigation over whether WaMu Capital Corp., WaMu Asset Acceptance Corp. and certain of their current and former officers and directors (David Beck, Diane Novak, Rolland Jurgens and Richard Careaga) issued or signed false or misleading registration statements or prospectus supplements in connection with the offerings of the Certificates (the “Action”). In this Action, the Court appointed Lead Plaintiff Policemen’s Annuity and Benefit Fund of the City of Chicago, Lead Plaintiff Doral Bank Puerto Rico and Plaintiff Boilermakers National Annuity Trust to serve as "Lead Plaintiff", and has decided that the law firms of Cohen Milstein Sellers & Toll PLLC and Scott + Scott LLP (“Lead Counsel”) to serve as Lead Counsel in the Action.
The Defendants have agreed to pay $26 million in cash into the Settlement Fund. The balance of this fund, after payment of Court-approved attorneys’ fees and expenses, taxes, and the costs of claims administration, including the costs of printing and mailing this Notice and the cost of publishing newspaper notice (the “Net Settlement Fund”), will be divided among all Class Members who submit valid Claim Forms.
